This Privacy Policy is intended to inform customers and visitors of Pescariu Sports & Spa, as well as anyone visiting our website, about how we process personal data within our activities. The data processing operations carried out by Pescariu Sports & Spa comply with the current regulations on the protection of personal data, including the provisions of the General Data Protection Regulation (EU Regulation 2016/679 on the protection of individuals regarding the processing of personal data and the free movement of such data and repealing Directive 95/46/EC, hereinafter "GDPR") and subsequent national and European legislation. 1. Purposes and Legal Basis of Processing Personal Data

A. If you are a client or potential client of PESCARIU SPORTS & SPA Club, we inform you of the following:

a) We need your identification data, your photograph, contact information, and a series of information derived from the documents attesting to the payments made under the recreation service supply contract (by which you become a member of Pescariu Sports & Spa Club). In the case of this data, processing is necessary for the execution of the recreation service supply contract or, in the case of potential customers, to take the necessary steps, at your request, to conclude the contract [Article 6(1)(b) of the GDPR], and respectively, for issuing the Pescariu Sports & Spa membership card. Also, some data is necessary for the completion of payments and the issuance of invoices under the recreation service supply contract, according to the current fiscal law norms [Article 6(1)(c) of the GDPR]. Your contact information is also necessary to contact you regarding the services covered by the contract (e.g., transmitting information about the classes you attend, confirming appointments, providing information about the operating schedule in certain periods of the year, information about updating the Privacy Policy, information about the suspension of activity on the www.pescariusports.ro website during maintenance work, and similar). Additionally, certain data is collected, with the Clients' consent, so that they can benefit from the integrated services and facilities provided by Pescariu Sports & Spa Club (vehicle registration number to ensure free parking within the Club, the name of the spouse and the name of the child/children to benefit from certain facilities). Lastly, since the membership card issued under the subscription is individual, non-transferable, and non-personalized, we need your photograph to ensure that access to the Club's premises is only granted to authorized persons. Specifically, under the subscription, each client has an individual electronic record created, accessible only to personnel with explicit responsibilities in this regard. Through this individual record, authorized personnel at Pescariu Sports & Spa have access to your identification data, contact information, your photograph, subscription type, and the history of visits to Pescariu Sports & Spa Club. This information is necessary to ensure that each client accesses the type of subscription to which they are authorized according to the contract, so that all our clients enjoy a favorable experience during their visits, and to ensure that contractual terms are respected.

b) Any individual can express their agreement to receive the Pescariu Sports & Spa Newsletter and/or other communications about our activities (offers, contests, loyalty programs, invitations to various events, etc.) for promotional and marketing purposes. For Club customers, we can send personalized offers based on their preferences for our services. This information will be transmitted to you through the communication channel you prefer, either email or SMS (in principle, communications from Pescariu Sports & Spa will be sent via email, but you can opt for a different communication channel at any time). It is our duty to ensure that you receive only the content you want. Therefore, if you are a Club customer, you can choose whether you want to receive this type of communication, whether you opt only to receive the Pescariu Sports & Spa Newsletter, personalized offers, or both types of communications. Since we respect your privacy, if you do not give your consent in this regard, your data will only be processed for the purpose of executing the recreation service supply contract, as mentioned earlier. For marketing and promotional communications, we need your contact details (name, surname, email address, and phone number). The legal basis for processing this data is your freely given consent [Article 6(1)(a) combined with Article 7 GDPR]. You can withdraw your consent at any time, without affecting the quality of the services we provide or those you will benefit from in the future, by sending us an email at contact@pescariusports.ro with the subject "Unsubscribe" or a written request to the address 3 Glodeni Street, Bucharest, Romania. Additionally, you have the option to unsubscribe with a single click within the unsubscribe option in any Newsletter we send you. The withdrawal of consent does not affect the legality of processing based on it before its withdrawal.

c) For the safety of our customers, their property, and Pescariu Sports & Spa Club, the Club is under constant video surveillance (except for private areas such as changing rooms). The monitored areas are visibly marked. The recorded information is necessary for the defense of the legitimate interests of the data controller [Article 6(1)(f) GDPR] and may be communicated, in accordance with the law, to law enforcement or criminal investigation authorities.

d) Pescariu Sports & Spa processes personal data belonging to minors only when there is explicit consent given in this regard by parents or legal representatives, with respect to all guarantees provided by applicable law. We process the identification data of children, necessary for enrollment in classes or swimming or tennis courses, depending on the type of subscription. Regardless of the type of subscription, a personal record will be created for children to ensure their access to the Club (whether minors accompany their parents or are members themselves). Separately, parents can choose whether they agree to the possibility of using photos or video recordings featuring their children in the online environment, for the purpose of promoting sports activities from an early age. Parental consent will be requested differentially, depending on the categories of processed data (whether it is the identification data of minors necessary for the creation of the personal record granting them access to the Club, or the photography of minors). To prove the age of the minor and to benefit from the facilities provided by Pescariu Sports & Spa, parents who are members of the Club will present the child's birth certificate, but no copies of this document will be collected.

e) One of our missions is to improve the quality of life by encouraging a healthy and active lifestyle. We are proud that these values have been embraced by our customers, and based on the explicit consent of customers and Club visitors, we use images captured in photographs or video recordings for the purpose of promoting the Club and our community. We collect these images transparently from our customers (for example, a snippet of a workout, a photo from a tennis tournament, or a football match). We use these images both online and offline: on the www.pescariusports.ro website, on the social media pages we administer, or those administered in collaboration with us. Pescariu Sports & Spa undertakes not to display materials that could affect the image of customers and not to disclose the identity of individuals appearing in photos or video recordings without their consent. Since we respect the right to privacy of all our customers and visitors, consent for the processing of this data can be withdrawn at any time without affecting the quality of the services we provide. f) Pescariu Sports & Spa has exceptional access to health data of Club members. Pescariu Sports & Spa may request a member to present a medical certificate regarding their health. This information is necessary to demonstrate that the Club member is fit to engage in sports activities and that there are no conditions that could endanger the member or others in the Club. After presenting this evidence, health data of the Club member is not stored by the "Dinu Pescariu" Foundation.

B. If you are a mere visitor of PESCARIU SPORTS & SPA Club, please consider the following:

a) If you are a visitor of Pescariu Sports & Spa Club (for example, if you accompany a Club member), we will generally only need your identification data (name, first name) for security reasons [Article 6(1)(f) GDPR].

b) You can choose to receive news about Pescariu Sports & Spa activities even if you are not yet our customer. With your consent, to the extent that you are interested in our services following the visit, in addition to your identification data, we will collect your contact information (phone number, email address) by completing the Visitor Form, in order to send you information about our activities (Pescariu Sports & Spa Newsletter and other information). In this case, the legal basis for processing this data will be your freely given consent [Article 6(1)(a) combined with Article 7 GDPR], which you can withdraw at any time without affecting the quality of the services you may benefit from in the future (if you choose to do so), by sending us an email at contact@pescariusports.ro or a written request to the address 3 Glodeni Street, Bucharest, Romania. You will also have the option to unsubscribe by clicking within the option in any Newsletter we send you.

c) For the safety of our customers, their belongings, and Pescariu Sports & Spa Club, the Club is permanently video monitored (excluding private areas such as changing rooms). Monitored areas are visibly marked. The recorded information is necessary to protect the legitimate interests pursued by Pescariu Sports & Spa [Article 6(1)(f) GDPR] and may be communicated, in accordance with the law, to law enforcement or criminal investigation authorities.

d) Our mission is to improve the quality of life by encouraging a healthy and active lifestyle. We are proud that these values have been embraced by our customers, and based on the express consent of Club visitors expressed through the Visitor Form, we use images captured in photos or video recordings for the promotion of the Club and our community. We collect these images transparently with respect to our customers and visitors (for example, a snippet of a workout, a photo from a tennis tournament, or a football match). We use these images online or offline: on the website www.pescariusports.ro, on the social media pages we administer, or those administered in collaboration with us. Pescariu Sports & Spa undertakes not to display materials that could affect the image of customers and not to disclose the identity of individuals appearing in photos or video recordings without their consent. Since we respect the right to privacy of all our customers and visitors, consent for the processing of these data can be withdrawn at any time without affecting the quality of the services we provide. C. If you wish to apply for a job through the website www.pescariusports.ro, in the Careers section, we ask you to provide us with a series of information necessary to analyze your application and to contact you in this regard (name, email address, phone number, your message). Through the form, you have the opportunity to upload a file (such as your CV, a photo, or other documents that you consider relevant to highlight your experience for the position you are applying for). By completing this form and transmitting any documents, you give your consent to the processing of your personal data [art. 6 para. (1) lit. a) GDPR]. We will use this data only for the purposes related to the analysis of your application, to contact you for an interview, and to exchange the necessary information in this regard.

D. If you are a user visiting the website www.pescariusports.ro, please consider the following:

By accessing the website www.pescariusports.ro, various pop-up windows containing announcements related to our activities and general offers may be displayed.

Pescariu Sports & Spa is constantly in touch with its customers and partners, valuing information transparency and continuous improvement based on suggestions and feedback received from you. Thus, when a user posts a comment under one of the Club's posts on social media (Facebook or Instagram), clicks the Like/Other reaction button, shares the Club's posts, or sends a message on one of the pages administered by Pescariu Sports & Spa (Pescariu Sports & Spa Facebook Page; Pescariu AQUA Facebook Page; Pescariu Sports & Spa Instagram Page; Pescariu AQUA Instagram Page) or in our group (Facebook Group for Pescariu Sports & Spa Club members), we will primarily have access to the data thus made available (username, profile picture, the action taken—Like/Other reaction or the content of the comment, as applicable).

2. Duration of personal data processing

In the case of data collected in the context of the conclusion and execution of the leisure services supply contract, they will be stored for the entire duration of the contractual relationships. For data not collected in the context of the execution of the leisure services supply contract, they will be processed only as long as necessary to achieve the purposes of processing such data.

For contact data collected for the transmission of the Pescariu Sports & Spa Newsletter, they will be retained only as long as you wish to receive information about our activities. You can withdraw your consent for the processing of contact data for promotional and marketing purposes at any time by sending us an email at contact@pescariusports.ro with the subject "Unsubscribe" or a written request to the address Str. Glodeni nr. 3, Bucharest, Romania. If you withdraw your consent through unsubscribing, and to the extent that there is no other legal basis for processing this data, you will no longer be contacted, and your data will be deleted.Regarding photographs of Club Pescariu Sports & Spa customers or, as the case may be, video recordings during workouts used for promotional and marketing purposes (for which customers have consented by signing the consent form in the internal regulations), they can withdraw their consent at any time. If you send us such a request, we will take the necessary steps to ensure that your image no longer appears online and offline, on the website www.pescariusports.ro, on social media pages, in newsletters, banners, posters, or in any other forms of promotion we use (if you expressly request, we will take the necessary steps to delete these images, including from our databases).

Video recordings collected through CCTV systems are periodically deleted, following procedures and internal regulations regarding the protection of personal data. Please note that, in all the above cases, we may retain your data for a longer period when necessary to protect the legitimate interests of the "Dinu Pescariu" Foundation, for the establishment, exercise, or defense of a legal claim, or when there is a legal obligation to store the data. 3. Confidentiality and Security of Personal Data ProcessingPescariu Sports & Spa takes all necessary and reasonable organizational and technical measures to protect the confidentiality and security of personal data processing.

We store your personal data in secure operating environments that are not available to the public and are accessible only to authorized employees or collaborators with specific responsibilities in this regard. They have been informed and trained in advance to ensure an adequate level of protection for your data, in compliance with the requirements for data confidentiality and security as mandated by law and in accordance with the contractual terms and internal policies on personal data protection implemented at Pescariu Sports & Spa.

Any possible subcontracting of services involving the processing of personal data will be done only with the authorization of Pescariu Sports & Spa, under restrictive conditions, and with verification of compliance with confidentiality and security guarantees.

4. Disclosure and Transfer of Personal DataPescariu Sports & Spa will never disclose your personal data to a commercial company or third-party organization intending to use them for direct marketing purposes, except in cases where you expressly and priorly consent to this.For justified reasons related to the nature of our activities, your data may be disclosed to certain external collaborators in the fields of PR, Accounting, or IT&C (for example, the provider of software solutions for hosting the website www.pescariusports.ro or for transmitting the Newsletter).
